When an employer sends an executive on a business trip, the relationship of responsibility does not stop at the office door. It continues through every airport, every hotel, every city the executive visits on behalf of the company.<\/p>\n

This responsibility has a name: Duty of Care.<\/p>\n

And although the term has been circulating in corporate discourse for years, its real meaning, what it means legally, what it means ethically and what it means in practice, often remains unclear. As a result, many organizations believe they are fulfilling it when in reality they are ignoring it.<\/p>\n

What Duty of Care Is<\/strong><\/p>\n

In the context of business travel, Duty of Care is the legal and ethical obligation of the employer to protect the health, safety and wellbeing of employees who travel on behalf of the organization.<\/p>\n

It is not a choice. It is not a best-practice policy. It is an obligation that stems from the employment relationship and, in many countries, is enshrined in law.<\/p>\n

The employer who sends an executive to a high-risk area without adequate preparation, who does not know where their people are at critical moments or who has no emergency response plan, is not fulfilling Duty of Care. And that has consequences.<\/p>\n

The Legal Dimension<\/strong><\/p>\n

The legal obligation of Duty of Care differs from country to country, but the underlying principle is shared: the employer must take reasonable measures to protect employees carrying out duties on their behalf.<\/p>\n

In many European countries, labor legislation extends this obligation to the context of business travel. Accidents, illness, geopolitical incidents or emergency situations that occur during a business trip can create legal liability for the employer if it is shown that adequate preventive and protective measures had not been taken.<\/p>\n

Ignorance is not a defense.<\/p>\n

An employee who travels on behalf of the company leaves the safety of their familiar environment and is exposed to risks that would not exist if they were not traveling. Aviation incidents, crime, political unrest, health crises. None of these are part of the employee’s normal daily life.<\/p>\n

The organization that assigns this risk to the employee has an ethical obligation to manage it responsibly. This is not philanthropy. It is a basic principle of corporate responsibility.<\/p>\n

What Duty of Care Includes in Practice<\/strong><\/p>\n

Fulfilling Duty of Care is not an abstract concept. It is a set of specific obligations and practices.<\/p>\n

Access to risk information.<\/strong> The employer must inform the employee of any risks at the destination before the trip. Travel advisories, health requirements, area safety conditions.<\/p>\n

Travel insurance with adequate coverage.<\/strong> Not simply standard insurance, but coverage that reflects the real risks of the trip. Medical evacuation, cancellation, emergency legal support.<\/p>\n

Knowledge of traveler location.<\/strong> The organization must know at all times where its traveling executives are, particularly in higher-risk regions.<\/p>\n

Emergency response plan.<\/strong> What happens if something goes wrong? Who communicates with whom? What are the evacuation or support procedures?<\/p>\n

Real-time support.<\/strong> The ability for the employee to reach the organization and receive assistance at any time, from anywhere.<\/p>\n

The Gap Between Policy and Practice<\/strong><\/p>\n

Many organizations have a written travel policy that mentions Duty of Care. Few implement it systematically.<\/p>\n

The gap typically appears at the same points: inadequate insurance coverage, absence of a traveler tracking system, no emergency response plan and insufficient information about destination risks.<\/p>\n

This gap is not simply a legal risk. It is a matter of corporate culture and trust.<\/p>\n

Duty of Care and Talent Management<\/strong><\/p>\n

There is a dimension that is often overlooked: the impact of Duty of Care on employee engagement and retention.<\/p>\n

Employees who feel that their organization protects them when they travel, who know that support exists if something goes wrong, develop greater trust in their employer. By contrast, employees who feel exposed to risks without an adequate safety net develop anxiety and resistance to traveling.<\/p>\n

Duty of Care is therefore also an HR tool that influences the willingness of executives to travel and their trust in the organization.<\/p>\n

Geopolitical Risk and the New Reality<\/strong><\/p>\n

In an environment of heightened geopolitical instability, Duty of Care acquires new urgency. Destinations previously considered safe can change status rapidly. Situations assessed as low risk can escalate.<\/p>\n

Organizations with a strong Duty of Care framework can respond quickly. They know where every executive is, they have a plan and they can activate support in real time.<\/p>\n

Those that do not discover their gaps at the worst possible moment.<\/p>\n
